Terms of Service

By accessing our website or using our services, you agree to be bound by these Terms of Service and any additional terms applicable to specific services.

Scale Payments provides credit card processing, point-of-sale systems, gateway services, gift card programs, and related merchant services. Specific service terms are detailed in your merchant agreement.

You must be at least 18 years old, legally able to enter into contracts, and operate a legitimate business in the United States to use our services.

Account approval is subject to underwriting review. You agree to provide accurate information and notify us of any material changes to your business within 30 days.

All fees are disclosed in your merchant agreement. We do not charge undisclosed fees. Pricing changes require 30 days written notice.

You agree to comply with all card brand rules (Visa, Mastercard, Discover, Amex), PCI-DSS requirements, and applicable laws. Violations may result in fines or termination.

You may not use our services for illegal activities, MATCH-listed business types without disclosure, fraudulent transactions, or any activity that violates card brand rules.

You are responsible for chargebacks and associated fees on your account. We provide tools and human support to help you respond, but final liability rests with you.

Either party may terminate the agreement with 30 days written notice. We may terminate immediately for cause (fraud, breach, regulatory issue). Funds may be held for chargeback liability post-termination.

To the fullest extent permitted by law, Scale Payments' liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify Scale Payments against claims, losses, and expenses arising from your use of services, your violation of these terms, or your violation of law.

All Scale Payments trademarks, logos, software, and content are the property of Scale Payments or its licensors. You may not use them without written permission.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Disputes shall be resolved in New Jersey state or federal court.

We may update these Terms from time to time. Material changes will be posted with a revised effective date. Continued use constitutes acceptance.
